4. Intellectual Property

All content on the Services—including music, lyrics, artwork, logos, photos, videos, designs, and text—is owned by us or our licensors and protected by copyright, trademark, and other laws.

You may not:

•  Use our trademarks or band name in a way that suggests endorsement.

Limited personal, non-commercial use is allowed (e.g., streaming our music previews).

 

5. Purchases and Payments

We may offer merchandise, tickets, digital content, or other items for sale.

•  Prices and availability can change without notice.

•  Payments are processed via third-party providers (e.g., Stripe, PayPal)—we don’t store full payment details.

•  All sales are final unless stated otherwise (e.g., digital downloads are non-refundable except where required by law; merch returns follow our separate Returns Policy. 

•  You are responsible for any taxes.

•  We may cancel orders for fraud, errors, or unavailability.

 

6. Shipping, Returns, and Refunds

•  Our total liability is limited to the amount you paid us in the 12 months before the claim (or $100 if no payment).

•  We are not responsible for third-party actions, links, or content.

Some jurisdictions don’t allow exclusions, so these may not apply fully to you.

 

8. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Services, your content, or violations of these Terms.

 

9. Termination

We may suspend or terminate your access anytime for any reason, including violations. Sections surviving termination include IP, disclaimers, liability, indemnification, and governing law.

 

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Nevada, without regard to conflict of laws principles.

Any disputes will first attempt informal resolution. If unresolved, they will be resolved exclusively in the state or federal courts located in Clark County, Nevada. You waive any objection to venue.

For Nevada residents: These Terms comply with applicable Nevada consumer protection laws.

 

11. Miscellaneous

•  Entire Agreement: These Terms (plus our Privacy Policy) are the full agreement.

•  Severability: Invalid provisions don’t affect the rest.

•  No Waiver: Failure to enforce doesn’t waive rights.

•  Assignment: We may assign these Terms; you may not without consent.
